Who Are We

At AEL, Kenneth Abell, David Askew and Scott Landau have created a unique law firm that offers a combination of civil, criminal, regulatory and compliance expertise, with a focus on representing individuals as well as institutions — from small businesses to large public companies and nationally recognized healthcare systems and hospitals — in high-stakes government investigations, enforcement matters and prosecutions. While many law firms claim expertise in government investigations and healthcare law, none of them can match AEL's combination of criminal, civil and regulatory expertise.

AEL's founding partners are all former federal prosecutors who have worked in both criminal and civil divisions of the two most prestigious U.S. attorney's offices in the country — the Eastern District of New York (EDNY) and the District of New Jersey (DNJ). In their roles as federal prosecutors, AEL partners have proven themselves to be experts in the field of healthcare and white-collar workers. Prior to the founding of AEL, David Askew and Kenneth Abell held the positions of heads of the relevant medical practices of their offices — David was the head of the Department of Health and State Fraud in the Criminal Division of DNJ, and Ken was the head of the Department of Health Fraud in the Civil Division of EDNY. Scott Landau also held the position of AUSA at EDNY, dealing with civil health fraud issues. As prosecutors, all three AEL partners have conducted large, complex federal investigations and prosecutions in a wide range of subject areas, including «big pharma», hospital and medical facility cases, mortgage fraud, securities fraud, bank and wire fraud, tax fraud and cybercrime.

Being on both the criminal and civil side, there simply isn't a boutique better equipped to guide customers through the increasingly common parallel criminal/civil investigations and high-stakes litigation conducted by the U.S. Attorney's Office, the U.S. Department of Justice (DOJ), the U.S. Department of Health and Human Services (HHS), the U.S. Food and Drug Administration (FDA), the Securities and Exchange Commission (SEC) and state attorneys general. Currently, AEL represents clients in parallel civil/criminal investigations conducted by the United States. The U.S. Attorney's Offices of the Eastern District of New York, the Southern District of New York, the District of New Jersey and the District of Massachusetts, as well as the U.S. Securities and Exchange Commission. And, like AUSAS, AEL partners investigated, prosecuted, or supervised some of the most significant parallel investigations conducted at EDNY and DNJ, including important cases that began as qui tam/whistleblower actions. Their case credits include:

  • Criminal and civil part of one of the largest in the history of international bribery and corruption cases initiated in accordance with the Law on Corruption Abroad (FCPA) against a medical organization; 
  • The civil part of the investigation that led to the historic $16.6 billion resolution against the financial institution after the «mortgage crisis”, which was at the time the largest settlement with a single legal entity in U.S. history;
  • The criminal part of the “issue in the news news Agency”, and the blade edge is parallel investigation with the SEC, in which the attackers entered the major news agencies and then sold the stolen material non-public information for traders in securities that trade on the information before the press releases were published;
  • Investigation and final settlement, with one of the largest pharmaceutical distributors in the U.S., associated part of injectable biologics business.

But AEL goes beyond using its previous public services and expertise. AEL partner Scott Landau also worked for many years as a full-time consultant in the nationally recognized hospital system in New York. In this role, Scott not only represented the hospital in complex civil lawsuits and pending government investigations, but also advised the hospital on a variety of general counsel issues. Among other things, Scott has designed the relevant transactions, advised the hospital on doctors' pay and care delivery models, and has an „in-house“ understanding of the complex issues affecting healthcare providers.

With such experience and knowledge, AEL is truly a triple threat, with expertise in criminal, civil and domestic regulatory matters, and has become known for its holistic and creative strategies.
