Rick has handled all phases of complex litigation from investigation through trial and appeal, as well as in arbitration and mediation. Rick has litigated cases involving a broad spectrum of substantive issues, including intellectual property, securities, business torts, contract, fiduciary obligations, construction, real property disputes, non-compete agreements, and all types of fraud claims. He regularly counsels clients in ways to avoid or minimize the risks attendant to their businesses and transactions.
In intellectual property matters, Rick has represented a wide variety of companies in intellectual property disputes, including patent infringement, licensing disputes, and trade secret and other forms of unfair competition, related to pharmaceuticals, biologics, chemicals, mechanical inventions, and software. In addition, Rick has extensive experience with matters litigated before the Patent Trial and Appeal Board under the America Invents Act.
In his securities practice, Rick has defended broker-dealers, issuers, and directors and officers against direct and derivative claims arising under the Securities Act and Securities Exchange Act, as well as claims of fraud, negligence, Sarbanes-Oxley violations, breaches of fiduciary duty, and related ERISA claims. Rick also has broad experience handling customer arbitrations for broker-dealers.
Rick has represented numerous clients in investigations by regulatory authorities, and has led numerous internal investigations for clients, including matters dealing with trading issues, employee dishonesty and breaches of fiduciary duty, and accounting issues.
