Tracey Diamond counsels clients on workplace issues, provides harassment training, conducts internal investigations, drafts policies and procedures, negotiates employment and severance agreements, advises on independent contractor, FMLA and ADA compliance issues, and partners with clients to structure their workforce in the most efficient and effective way possible.
Tracey has argued before the Equal Employment Opportunity Commission, state administrative agencies and federal and state courts. She handles matters in the enforcement or defense of non-competition and non-solicitation clauses and defense against discrimination and harassment claims. In the labor area, Tracey assists clients with negotiation of collective bargaining agreements and defense of grievances.
Tracey is a member of the firms COVID-19 Response Team, advising clients on workplace issues related to the global pandemic. She is also a member of the firms Food and Beverage and Cannabis Industry groups and advises clients in these industries on their unique labor and employment needs, including workplace counseling, noncompete and labor union agreements.
Before joining the firm, Tracey was director of human resources and operations for a large nonprofit organization, where she was responsible for all human resources issues for more than 1,000 employees and contract administration for the agencys union. She also was general counsel of a national retail optical company, where she oversaw the companys employment law matters, negotiated commercial contracts and managed the litigation docket. Other previous legal experience includes clerking for a federal judge in the Southern District of New York and work at several large law firms.
Tracey speaks and writes frequently about a multitude of employment law issues. She is the editor of the Hiring to Firing Law Blog, a go-to resource for all human resources and employment law issues affecting the workplace? from hiring to firing.
Tracey is a qualified mediator for the New Jersey Superior Court. She also served as an adjunct professor at Drexel University Kline School of Law.
