Tom received the Consumer Champion Award from the Kansas Trial Lawyers Association in 2015 for his work in an auto-semi truck crash case involving his client, Diana Hilburn. The jury in that case returned a verdict that exceeded the $250,000.00 Kansas statutory damage cap for pain and suffering. The trial court reduced the verdict to the damage cap. Tom appealed challenging the constitutionality of the Kansas cap on pain and suffering under the Kansas Constitution Bill of Rights.. The Kansas Court of Appeals affirmed the trial courts reduction and the constitutionality of the cap. The Kansas Supreme Court granted Diana Hilburn's petition for review.

On June 14, 2019, the Kansas Supreme Court handed down its decision finding the statutory cap on pain and suffering to be unconstitutional in Hilburn v. Enerpipe, 309 Kan. 1127, 442 P.3d 509 (2019). Tom tried the case to a jury verdict, wrote the appellate briefs and argued the case to the Kansas Court of Appeals and to the Kansas Supreme Court. Tom is to receive a Special Recognition Award from the Kansas Trial Lawyers Association for his work and advocacy in Hilburn.
