Marc Bruner is a partner with the firm's Environment, Energy Resourcespractice. Marc represents governmental entities and private companies in a widevariety of environmental, land use, and natural resource matters. He counselsclients on formulating long-term development strategies, preparing andprocessing environmental studies and land use plans, and obtaining the necessaryfederal, state and local permits and approvals for a broad range of private andpublic development projects? including utility-scale solar power facilities,residential subdivisions, large commercial and mixed-use developments,hospitals, university campuses, maritime and airport expansions, research anddevelopment facilities, industrial projects, water supply infrastructure, androadway and transit improvements. Marc also counsels clients on a wide array ofregulatory compliance matters involving air quality, wetlands and water quality,and the handling and disposal of hazardous wastes.
Marc's work involves avariety of federal land use and environmental laws, including the NationalEnvironmental Policy Act, the Endangered Species Act, the Clean Water Act, theMagnuson-Stevens Fishery Conservation Act, the Clean Air Act, and the FederalLand Policy and Management Act. Marc also has extensive experience with theunique set of California laws and regulations affecting development in thestate, including the California Environmental Quality Act, the Porter-CologneWater Quality Control Act, the California Endangered Species Act, theCarpenter-Presley-Tanner Hazardous Substance Account Act, the Integrated WasteManagement Act, the Subdivision Map Act, the Planning and Zoning Law, theCalifornia Building Code, and various laws, regulations and local ordinancesgoverning water supply, green building requirements, use of recycled water,coastal development, development along the banks of streams and rivers, statelands and the public trust, conversion of agricultural lands, historicresources, hazardous materials and wastes, and flood protection and safety. Marchas a keen understanding of the differences between the federal and state lawrequirements, as well as the areas of overlap and the opportunities and bestpractices for coordination.
Marc is co-author of the chapters coveringwetlands and endangered species in Curtin's California Land Use and PlanningLaw. He also speaks regularly on environmental and land use topics,including CEQA, NEPA, wetlands and endangered species, and water supplyrequirements for new developments.
