Brad's clients have included vesselowners, charterers and manufacturers, marine classification societies, oil,technology and insurance companies, marine construction, dredging and salvagecompanies, and cargo interests.
Bradrepresented the petitioner in Exxon Corp. v. Central Gulf Lines, Inc., 500 U.S.603 (1991), in which the U.S. Supreme Court overruled its own 135 year-oldprecedent, and expanded federal admiralty jurisdiction in favor of his client.He has particularly substantial experience in defending marine classificationsocieties in major malpractice cases. He was part of the team whichsuccessfully defended the American Bureau of Shipping in the $1 Billion suitbrought against it in New York by the Kingdom of Spain in connection with the massiveoil spill from the M/T PRESTIGE off the coast of Spain. He also represented theFrench classification society Bureau Veritas in a case involving thecatastrophic failure and sinking of the M/V STAR OF ALEXANDRIA. He obtained thefirst federal maritime decision to clearly hold that, under the FederalArbitration Act, an arbitration provision in an international commercialagreement must be in a writing signed by the parties or evidenced by anexchange of correspondence to be enforceable. He recently successfully defendeda boat manufacturer in a recreational boating case arising from a propellerstrike incident in Boston Harbor, which tragically resulted in severe injuriesto a passenger.
