Dana A. Dwiggins in the Managing Partner of the Firm, where she focuses her practice primarily on probate and trust litigation, small business litigation, trust and estate administration, guardianships, and trust and wills. She routinely represents heirs, beneficiaries, creditors and private and professional fiduciaries in both contested and uncontested matters affecting all aspects of trusts and estates. She has substantial experience litigating matters involving claims for breach of fiduciary duty, including disputes involving investments allocations, fiduciary accounting, estate tax issues, valuation of trust and estate assets, fiduciary and trustee fees, and disputes concerning the characterization of receipts under UPIA, testamentary and contractual capacity, undue influence, fraud and unjust enrichment.

Ms. Dwiggins experience also extends out of court, where she has successfully negotiated settlements for clients involving complex trust and estate matters. In 2014, Ms. Dwiggins assisted the Firm in negotiating a settlement that netted the Firms client $50 million.

Ms. Dwiggins litigation experience extends to not only state court but federal court as well, at both the trial and appellate levels, including case assessment, motion practice, hearings, discovery, depositions, trial, settlement conferences, mediations and appeals. Ms. Dwiggins has also successfully argued before the Nevada Supreme Court. Ms. Dwiggins also represents and assists personal representatives in handling all aspects of the administration of probate and trust estates. In connection with the same, Ms. Dwiggins works closely with accountants to ensure the timely filing of trust and estate tax returns, preparation of accountings, the preparation of inventories and the distribution of trust and estates.

Ms. Dwiggins is a member of the State Bar of Nevada, where she serves as the President of the Probate and Trust Section and a Member of the Client Security Fund Committee. Ms. Dwiggins is additionally a member of the American Bar Association and Clark County Bar Association. Ms. Dwiggins is licensed to practice law in the State of Nevada, United States District Court for the District of Nevada and the U.S. Court of Appeals Ninth Circuit.

Ms. Dwiggins also serves as the President of the Board of Trustees for Safe Nest, a nonprofit assisting victims of domestic violence, as well as the Chair of the Fund Development Committee and Member of the Executive Committee and Audit Finance Committee.
